Sejarah membuktikan luasan Kawasan Kerajaan Patani Raya seluas \u00b116.495 km\u00b2 ini mencakup wilayah-wilayah yang saat ini berada di bawah administrasi Thailand Selatan dan berbatasan langsung dengan Malaysia, yaitu: Provinsi Pattani (luas inti kerajaan dan ibu kota lama), Provinsi Yala (Jala), Provinsi Narathiwat (Menara), Provinsi Satun (Setul) dan Sebagian wilayah Songkhla (Senggora), khususnya bagian barat\/selatan seperti daerah Canak, Thepha, Sabayoy, Nathawi, dan Sadao.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Status saat ini karena Kawasan Patani raya adalah bagian dari Negara Thailand, maka Secara hukum internasional, Patani tidak memiliki kedaulatan laut sendiri karena Patani  merupakan bagian resmi dari kedaulatan wilayah Kerajaan Thailand. Oleh karena itu, wilayah laut di pesisir Patani sepenuhnya tunduk pada batas laut teritorial dan Zona Ekonomi Eksklusif (ZEE) yang dikelola oleh pemerintah pusat Thailand di Teluk Thailand.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pesisir Patani membentang di sepanjang bagian selatan Teluk Thailand (Laut Tiongkok Selatan). Di bawah hukum laut internasional (UNCLOS), hak pengelolaan laut yang melekat pada wilayah pesisir ini meliputi: Laut Teritorial hingga 12 mil laut dari garis pantai basah dan Zona Ekonomi Eksklusif (ZEE) Hak berdaulat atas sumber daya laut hingga 200 mil laut, yang di kawasan ini berbatasan dan dibagi melalui perjanjian landas kontinen antara Thailand dengan Malaysia dan Vietnam di wilayah Teluk Thailand.<\/span><\/p>\n<p><b>Garis Batas Historis<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Pada masa puncak kejayaannya di bawah pemerintahan empat ratu (Ratu Hijau, Ratu Biru, Ratu Ungu, dan Ratu Kuning) pada abad ke-16 hingga ke-17, wilayahnya meluas menjadi Negeri Patani Besar. Selain wilayah selatan Thailand di atas, pengaruh kekuasaan dan wilayahnya juga mencakup wilayah utara Semenanjung Malaya yang kini menjadi bagian dari Malaysia, yaitu Negeri Kelantan, Negeri Terengganu (termasuk distrik Besut), Senggora (Songkhla) dan Pethalung (Phatthalung).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Wilayah luas ini kemudian menyusut dan terpecah setelah mengalami penaklukan oleh Kerajaan Siam (Thailand) pada tahun 1785 dan puncaknya melalui Perjanjian Bangkok 1909 (Anglo-Siamese Treaty), yang secara resmi membagi wilayah tersebut menjadi wilayah Thailand Selatan dan wilayah Malaysia Utara seperti sekarang.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Pada masa kejayaan Kesultanan Patani (sebelum dianeksasi secara resmi oleh Siam\/Thailand lewat Perjanjian Bangkok 1909), konsep kedaulatan laut tidak diukur dengan kilometer persegi formal seperti hukum modern, melainkan melalui kontrol rute perdagangan maritim dan pelabuhan di sepanjang Teluk Thailand. Saat ini, seluruh patroli keamanan maritim, penegakan hukum, serta eksploitasi sumber daya alam (seperti gas alam dan perikanan) di laut lepas pantai Patani sepenuhnya berada di bawah otoritas Angkatan Laut Kerajaan Thailand.<\/span><\/p>\n<p><b>Era Modern Patani Raya<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Jadi, era Modern dimana Patani raya dimasukkan oleh Pemerintah Inggris bagian dari Kerajaan Siam melalui Anglo Siam Treaty 1909, maka kedaulatan Patani Raya untuk memanfaatkan potensi lautnya semua dikendalikan oleh Bangkok. Teluk Patani memiliki potensi laut yang sangat kaya, selain potensi perikanan dan pariwisata\/ekowisata, juga mengandung sumber daya hidrokarbon dalam bentuk minyak dan gas alam.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Terutama potensi Hidrokarbon, Potensi migas di Teluk Patani (Pattani Basin, yang terletak di Teluk Thailand) sangat besar dan dikenal sebagai sumber produsen gas bumi terbesar di wilayah Teluk Thailand. Cekungan rift tersier berarah utara-selatan ini merupakan salah satu wilayah kerja migas paling prolifik di Asia Tenggara. Cekungan ini didominasi oleh gas alam dan kondensat, dengan jumlah kandungan minyak bumi yang lebih sedikit. cekungan ini mampu memproduksi sekitar 2 miliar kaki kubik gas per hari (Bcf\/d) dan sekitar 120.000 barel minyak serta kondensat per hari dari ribuan sumur aktif. Hidrokarbon di Teluk Patani utamanya terperangkap di dalam Miocene fluvial sandstone reservoirs (batupasir sungai zaman Miosen) dengan sistem patahan (graben) yang sangat padat. Secara geologis, tren formasi Teluk Patani ini memiliki korelasi erat dengan potensi raksasa (giant discovery) yang berada di Blok Andaman, perairan Aceh.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Maka, kedaulatan laut Patani Raya di era modern ini harus dikaji lebih mendalam oleh rakyat Patani, apalagi saat ini rakyat Patani yang diwakili oleh Barisan Revolusi Nasional (BRN) sedang melakukan negosiasi dengan pemerintah Thailand yang dimediasi oleh Pemerintah Malaysia. Tentunya, Kawasan laut Patani harus menjadi salah satu isu penting yang harus dibahas agar hasil dari sumber daya laut Patani ini kedepannya dapat dinikmati oleh rakyat Patani itu sendiri.<\/span><\/p>\n<p><b>UNCLOS menjadi aturan Internasional<\/b><\/p>\n<p><span style=\"font-weight: 400;\">Perundingan antara BRN dan Pemerintah Thailand masih berlangsung, meskipun Tarik ulur kedua belah pihak terjadi dan Malasysia sebagai mediator pun belum memainkan peran yang efektif dalam dialog-dialog yang sudah berlangsung. Buktinya, mediator belum mampu mengoerientasikan kedua pihak untuk membicarakan isu-isu substansial dalam perundingan.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Namun demikian, Jika kawasan Patani  memperoleh kemerdekaan, Pemerintahan sendiri atau otonomi khusus, status hukum laut dan perairan di wilayah tersebut akan mengalami perubahan mendasar berdasarkan hukum internasional, khususnya UNCLOS 1982 (Konvensi PBB tentang Hukum Laut).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Maka, kedua pihak harus mulai menyiapkan narasi yang tepat untuk mengatur segala sesuatu kesepakatan yang sesuai dengan UNCLOS. Pengalaman Timor Leste jika Patani Merdeka dapat menjadi rujukan, atau pengalaman Aceh dan BARMM juga dapat menjadi rujukan jika disepakati Pemerintahan Sendiri atau pun Otonomi khusus.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Secara garis besar, jika kedua pihak sepakat dengan Pmerintahan Sendiri ata status Otonomi Khusus, harus diingat bahwa wilayah Patani tetap berada di dalam kedaulatan Pemerintah Thailand, status lautnya tetap berada di bawah hukum nasional Thailand, namun tentunya diatur lebih lanjut dalam pembagian wewenang khusus, seperti Kedaulatan Tetap pada Thailand: Secara hukum internasional, Thailand tetap menjadi pemilik ZEE dan Laut Teritorial tersebut. Kapal asing dan hukum internasional tetap berurusan dengan pemerintah pusat di Bangkok. Selanjutnya Pengelolaan Sumber Daya Domestik: Berdasarkan undang-undang otonomi yang disepakati, pemerintah Patani biasanya diberikan kewenangan untuk mengelola perikanan lokal, konservasi laut, dan menerima bagi hasil (royalti) dari eksploitasi minyak atau gas alam di lepas pantai mereka, dan terakhir batas Sektor Kelautan Lokal, Biasanya ditentukan batas laut wilayah otonom (misalnya 4, 6, atau 12 mil laut dari pantai) khusus untuk yurisdiksi penegakan hukum daerah, retribusi daerah, dan hak nelayan tradisional setempat.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Jadi, delegasi BRN harus menyadari betul bahwa isu Kawasan laut merupakan salah satu agenda yang substansial yang harus diatur dalam kesepakatan bersama kedepannya.<\/span><\/p>","protected":false},"excerpt":{"rendered":"<p>By Maun Kagawasan: History shows that the Greater Patani Kingdom, covering an area of approximately 16,495 km\u00b2, encompassed territories that are currently under the administration of Southern Thailand and share a direct border with Malaysia, namely: Pattani Province (the core area of the kingdom and its former capital), Yala Province (Jala), Narathiwat Province (Menara), Satun Province (Setul), and parts of Songkhla Province (Senggora)\u2014specifically the western and southern regions such as Canak, Thepha, Sabayoy, Nathawi, and Sadao.
